【摘要】 《政府信息公开条例》开局之年依申请信息公开诉讼案的调查结果表明，立案受理环节的行政程序缺失是涉诉信息公开案发生的重要原因，《条例》第23条是行政主体拒绝公开信息的主要挡箭牌。同时，律师是信息法治建设的重要力量；公益诉讼正在通过申请信息公开的方式集中涌现；涉访信息公开比例较重；区县机关成为我国社会矛盾和信息公开案的高度聚集区与集中爆发区；原告胜诉率偏低，行政复议程序制度闲置等现象突出。

【英文摘要】 The investigation result of applied information publicity litigations in the first year ofGovernment Information Publicity Regulations implementation indicates that administrative proceduredeficiency in the steps of registering and accepting is the main reason of the litigations，because article 23provides those administrative agencies with a strong pretext for not publicizing information. Meanwhile，lawyersare an important force in legal construction of information and public interest litigations are emerging centrallyby means of information publicity application. Petition-involved information publicity occupies a largeproportion. Organs in districts and counties become the accumulation and high incidence areas of socialcontradictions and information publicity litigations. Plaintiff’s winning rate is low and the administrativereconsideration procedure is rarely started.
